Canada spouse visa requirements

Spouse visa is a sub-category of Canada family visa. It brings applications from a spouse, conjugal partner or common-law partner of a Canadian citizen or permanent resident in Canada. The prime focus of introducing family or spouse visa is to reunite families in Canada. However, there are certain requirements for a spouse visa for both sponsor and a sponsored individual to become eligible for the same. Some of them are:

Requirement 1: Status of relationship:

Both sponsor and the sponsored person need to demonstrate their status of relationship to be one of three categories including spouse, conjugal partner or common-law partner. Now, what are the differences among them?

Spouse:

An individual of at least 18 years of age and is lawfully married to sponsor can apply for partner support as a spouse. Both of them must register their marriage either in Canada or outside it.

Common-law partner:

In common-law partnership, a partner can be either of same-sex or opposite; however, must live with the sponsor as a couple for a minimum time period of 1 year. In contrast to spouse partnership, there’s no legal status given to the common-law partnership.

Conjugal partner:

Conjugal partner is someone who shares a physical bond with a sponsor; however, due to circumstances like immigration barrier, marital status, and more which are beyond the control of both partners, they are not able to live together.

Requirement 2: Eligibility requirements:

For sponsor:

• A sponsor must be at least 18 years old and:
• Canadian citizen or,
• A person registered in Canada as an Indian under the Canadian Indian Act or
• A permanent resident of Canada
• He/she must not be bankrupt or charged with any debt or offence
• He/she must not sponsor as a spouse in the past five years
• He/she is able to meet the basic requirements of his/her sponsored partner after immigration to Canada
• He/she must pay immigration bond, performance bond, and family support payments on the scheduled timeline
• He/she must not receive any social benefit for a reason other than a disability
• He/she must not charge in any sexual offence
• He/she must not be in a penitentiary, jail, reformatory or prison

For sponsored person:

A sponsored person must be at least 18 years of age and shared relationship status as a spouse, common-law partner or conjugal partner.

Requirement 3: documents:

Documents for sponsor:

• If a sponsor is a permanent resident in Canada, then he/she needs to show a copy of his/her permanent resident card.
• If the sponsor is a Canadian citizen, then a photocopy of Canadian citizenship certificate or card
• Letter from Canadian employer confirming details about job and salary
• Copy of passport
• Proof of civil status
• Passport sized photographs

Documents for the sponsored person:

• A sponsored person needs to provide proof of relationship to sponsor whether as a spouse, conjugal partner or common-law partner
• For spousal partnership: Only marriage certificate along with some photographs of marriage is enough for verification and evaluation of applications.
• For common-law or conjugal partnership:
• Joint bank account statement
• Credit card statement involving the activity of both partners
• A salutatory declaration signed from both partners and stating that the relationship between them is true and genuine
• Renting lease on the name of both partners,
• Besides it, they can show their pictures of dates or trips, conversations, phone call logs and more to prove their relationship.
• PCC (Police Clearance Certificate) from home country or any other country where he/she has lived for a period exceeding six months
• Copy of medical examination

Requirement 4: Fees

• For sponsoring spouse or partner without right of permanent resident fee: CAN $ 550 (including Sponsorship fee ($75), principal applicant processing fee ($475))
• For sponsoring spouse or partner with the right of permanent resident fee: CAN $ 1,040
